By accessing or using ohmyproperty.com ("Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site.
2. About Ohmyproperty
Ohmyproperty is an online marketplace connecting property seekers with real estate agents, agencies, and property owners in Ghana. We are a platform, not a real estate agent or broker. We do not own, sell, rent, or manage any property listed on the Site.
3. Eligibility
You must be at least 18 years old and capable of entering into binding contracts under Ghanaian law. If you are using the Site on behalf of a company, you represent that you have authority to bind that company.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You must notify us immediately of any unauthorized account use.
- We may suspend or terminate accounts that violate these Terms.
5. Listing Rules
If you list properties on the Site, you agree that:
- You have the legal right to list the property (ownership, agency agreement, or authorized representative status).
- All information, photos, and pricing are accurate and current.
- You will promptly update or remove listings when a property is no longer available.
- You will not post duplicate, misleading, or fraudulent listings.
- You will comply with all Ghanaian real estate regulations including the Real Estate Agency Act, 2020 (Act 1047).
6. Prohibited Conduct
You agree NOT to:
- Post false, misleading, or fraudulent information
- Impersonate another person, agent, or agency
- Scrape, harvest, or copy our data for commercial use
- Bypass our fees by arranging off-platform transactions after connecting through our Site
- Post content that is illegal, defamatory, obscene, or infringes on others' rights
- Introduce viruses, malware, or other harmful code
- Use automated tools to access the Site without our permission
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, software — is owned by Ohmyproperty or licensed to us. You may not reproduce, distribute, or create derivative works without written permission.
When you post listing content, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that content on our platform and marketing channels.
8. Third-Party Content & Links
The Site may contain links to third-party websites, agent profiles, and external services. We are not responsible for the content, accuracy, or practices of those third parties.
9. Disclaimers
The Site is provided "as is" and "as available." We make no warranties — express or implied — about:
- The accuracy of property listings
- The legitimacy, licensing, or reliability of agents listed
- The suitability of any property for purchase, rental, or investment
- Uninterrupted, secure, or error-free access to the Site
Always conduct your own due diligence, verify property titles at the Lands Commission, and engage a licensed lawyer before transacting.
10. Limitation of Liability
To the maximum extent permitted by law, Ohmyproperty is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including lost profits, data loss, or property transaction losses.
11. Indemnification
You agree to indemnify and hold harmless Ohmyproperty, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Any disputes will be resolved exclusively in the courts of Accra, Ghana.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Site after changes constitutes acceptance.
